Appellate mediation differs from mediation at the trial court level primarily because one party has already won the case. This workshop will explain the appellate mediation process in both state and federal courts. It will also explore both the appellant’s and the appellee’s unique motivations to settle the case and provide an overview of successful mediation techniques – what has worked and what has not among appellate mediators.
