Ethical decision making in mediation challenges us to consider the systems which guide our thinking and decision-making including a framework of rules, laws, statutes, standards, and MEAC opinions. Our training and grasp of rules and procedures guide us and our cognitive understanding or perspective of ethical dilemmas is impacted by past experience, psychology, identity, and personal bias. In this highly interactive presentation, including real-world application, we drill down to the complex nature of ethical decision-making in mediation, resulting in a set of core principles to apply to ethical decision-making. We will focus on how the Florida Rules for Certified and Court-Appointed Mediators and MEAC opinions can guide our decision making.
